On 8th October 2014 as a result of appeal lodged by the defence of MP Tadeusz Matyjek, The Appellate Court of Warsaw II Criminal Division revoked the judgment of The District Court in Warsaw finding MP T. Matyjek guilty of submitting false lustration declaration.

In verbal statement of reasons The Appellate Court of Warsaw explained that the court a qou appraised the evidence faultily and it failed to make an independent establishment of facts – the facts have been copied from reasons of another judgment, which constitutes flagrant violation of principle of free evidence appraisal.

Tha case of MP T. Matyjek, today having symbolic and historic dimension, initiated process of turbulent lustration in Poland. After the said judgment of The Appellate Court of Warsaw the case will now be heard once again by The District Court in Warsaw as a court of first instance.

After 15 years from instituting lustration proceedings against MP T. Matyjek, he remains innocent person.
